Terms of Service

Agreement

These Terms of Service govern your use of Summer, a voice-first personal assistant service operated by Quelrix Tech LLC. By creating an account, calling Summer, or messaging Summer on WhatsApp, you agree to these terms. If you do not agree, do not use the service.

Who may use Summer

You must be at least 18 years old to create an account. If you set up Summer for a loved one, you confirm that you have their permission to share their name, phone number, address, and preferences, and that they consent to receiving calls and messages from Summer.

What Summer does

Summer answers phone calls and messages and helps with everyday requests: booking rides, ordering groceries and food, pharmacy items, reminders, information lookups, and keeping designated family members updated. Summer places these requests with third-party providers on your behalf.

Summer is an assistant, not a medical, emergency, legal, or financial service.

Not an emergency service

Summer is not a substitute for 911, local emergency numbers, medical alert devices, or professional caregiving. In an emergency, call your local emergency number. Do not rely on Summer for urgent medical, safety, or crisis situations.

Pricing and payment

Summer is currently free to use during our early access period. Any goods or services ordered through Summer, such as rides, groceries, restaurant food, or pharmacy items, are paid separately, and during early access in Colombia these orders are paid in cash on delivery.

If we introduce paid plans, we will notify account holders in advance and you may cancel before any charge applies.

Third-party providers

Orders placed through Summer are fulfilled by independent third parties. Their availability, pricing, delivery times, and quality are their responsibility. We make reasonable efforts to place requests accurately, but we are not the seller or carrier of those goods and services.

Acceptable use

You agree not to use Summer to:

• Break the law or request illegal goods or services.
• Impersonate someone else or provide contact details you have no permission to use.
• Harass, threaten, or abuse our staff or automated assistant.
• Attempt to reverse engineer, overload, or interfere with the service.
• Resell or provide the service to third parties without our written consent.

Call recording

Calls with Summer may be recorded and transcribed to fulfill requests, resolve disputes, and improve service quality. By using the service you consent to this recording. Details are in our Privacy Policy.

Account suspension and termination

You may stop using Summer and delete your account at any time through our Data Deletion page or by emailing andrea@hisummer.app. We may suspend or terminate an account that violates these terms, creates a safety risk, or is used fraudulently. Where possible, we give notice first.

Disclaimers and limitation of liability

Summer is provided on an “as is” and “as available” basis, without warranties of any kind to the maximum extent allowed by law. We do not guarantee that every request will be completed, that third-party providers will perform, or that the service will be uninterrupted.

To the maximum extent permitted by law, Quelrix Tech LLC is not liable for indirect, incidental, special, or consequential damages, and our total liability arising from the service is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you paid nothing.

Indemnity

You agree to indemnify Quelrix Tech LLC against claims arising from your misuse of the service, from contact details you provided without permission, or from your breach of these terms.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. Disputes will be resolved in the courts located in Delaware, unless mandatory consumer protection law in your country of residence provides otherwise.

Changes to these terms

We may update these terms. When we do, we revise the effective date above and notify account holders by email or WhatsApp before material changes take effect. Continued use after that date means you accept the updated terms.
